LA STORIA INFINITA DEI LEP E DELL’AUTONOMIA DIFFERENZIATA TRA “NON C’È TRE SENZA DUE” e “NON C’È DUE SENZA TRE”

  Attualità e Giurisprudenza

Abstract

L’attuazione dell’art.

Abstract[En]

The never-ending story of lep and differentiated autonomy between “there is no three without two” and “there is no two without three”.
The implementation of the art. 116 third paragraph of the Constitution inevitably requires the implementation of the system of Essential Performance Levels concerning civil and social rights which is reserved to state legislation. The concrete definition of the LEP, however, is postponed from year to year and has not been resolved even after the establishment of a specific commission. The topic has returned to current affairs with the approval of law no. 86 of 26 June 2024 known as the Calderoli Law on Differentiated Autonomy.
The determination and guarantee of the LEP responds to two purposes: that of ensuring a correct transfer of functions, and the related one of identifying the quantity of resources necessary to fully finance the assigned functions, as the costs and standard requirements are necessary to specify the the amount of financing of the transferred functions, with the consequence that this determination has a decisive impact on the revenue recognized to the regions for the exercise of differentiated autonomy; purposes, therefore, with a strong financial character, which is of undoubted interest both for the region concerned, for the other regions and for national unity.
The Constitutional Court appears to have intervened “with the axe” in this regard, with its recent sentence no. 192 of 2024 declared the constitutional illegitimacy of some paragraphs of the 2023 budget law, as blank legislative delegations cannot be constructed on the LEP, such as the rules of the 2023 budget law to which the art refers. 3 paragraph 1 of the so-called Calderoli law, but which are insufficient to guide the Government in the exercise of delegated legislative power. The Constitutional Court on differentiated autonomy peremptorily affirms the clear distinction between essential levels of performance and the minimum core of the law.
